What is the difference between a durable and non-durable Power of Attorney?

A Durable Power of Attorney refers to a Power of Attorney which is drafted in such a way to continue to be effective, even if you are declared to be incompetent or unconscious. Without specific language, your power of attorney cannot act on your behalf during any period of time which you, yourself, are not competent to act. All Powers of Attorney, even a Durable Power of Attorney, will cease at death.
